USER AGREEMENT AND ONLINE STORE TERMS

§ 1. GENERAL PROVISIONS
1. These Terms govern the use of the website berserk.com.pl, including the conditions for purchasing shooting courses, gift vouchers, corporate events, and other goods and services offered by the Organizer.
2. Organizer details:

3. The Website is available in three language versions: Polish (berserk.com.pl/pl/), Russian (berserk.com.pl/), and English (berserk.com.pl/en/). These Terms apply to users of all language versions. In the event of discrepancies between versions, the Polish version takes precedence as the legally binding one.
4. Using the Website constitutes acceptance of these Terms.
5. Matters not covered by these Terms are governed by Polish law, in particular the Civil Code and the Consumer Rights Act of 30 May 2014.

§ 2. DEFINITIONS
The following terms are used in these Terms:
1. Organizer / Seller — CENTRUM ROZWOJU I BEZPIECZENSTWA Sp. z o.o., details specified in § 1 item 2.
2. Website — the website berserk.com.pl and all its subpages in all language versions.
3. Client / Buyer — a natural person, legal entity, or organization with legal capacity making a purchase through the Website.
4. Consumer — a natural person entering into a contract with the Organizer that is not directly related to their business or professional activity.
5. Training / Course — a paid shooting training service (pistol course, rifle course, combo, or other), conducted by the Organizer at a specific time and place.
6. Voucher — a paper document entitling the holder to receive a service from the Organizer of a specified nominal value or for a specific Training.
7. Corporate Event / Team Building — a service for companies and organized groups, including shooting training in a team-building format.
8. Product — a Training, Voucher, Corporate Event, or other goods/service offered on the Website.
9. Stripe — a third-party payment operator processing transactions on the Website.
10. Order — the Client's offer to purchase a Product, placed through the Website.
11. Agreement — a contract concluded between the Organizer and the Client remotely through the Website.

§ 3. TYPES AND SCOPE OF SERVICES
1. The Organizer offers the following Products through the Website:
a) Shooting trainings — individual and group (pistol course, rifle course, pistol+rifle combo, tactical shooting, IPSC, and others). The schedule is available in the calendar on the Website.
b) Gift vouchers — for a specific Training or for a specified monetary amount.
c) Corporate events and Team Building — organized on an individual basis for companies.
2. BERSERK Centrum is a training and education center. All services are of an educational and training nature in the field of safe handling of firearms.
3. Trainings are conducted by instructors speaking Polish, Russian, Ukrainian, and English.
4. Detailed descriptions, programs, and prices of Products are available on the relevant pages of the Website.

§ 4. CONDITIONS OF PARTICIPATION IN TRAININGS
1. Only adults (over 18 years of age) may participate in Trainings.
2. The Participant is required to:
a) Arrive at the Training sober and in a condition that allows safe participation in the sessions.
b) Comply with the safety rules in force at the shooting range.
c) Unconditionally follow the instructor's instructions.
d) Behave respectfully and not disturb other participants.
3. The Organizer reserves the right to refuse participation in a Training (or to remove a Participant during a Training) to a person who:
a) Is under the influence of alcohol, drugs, or other psychoactive substances.
b) Does not comply with the safety rules at the shooting range.
c) Behaves aggressively or poses a threat to other participants or instructors.
d) Does not meet the health requirements necessary for safe participation.
4. In the cases specified in item 3, the Client is not entitled to a refund for the Training.
5. The Participant takes part in the Training at their own risk. The Organizer is not liable for damages caused by the Participant's failure to follow safety instructions.
6. All persons using firearms during a Training are required to sign a health declaration and consent to safety rules before the sessions begin.

§ 5. PLACING ORDERS AND CONCLUDING THE AGREEMENT
1. Orders can be placed through the Website 24 hours a day, 7 days a week.
2. Placing an order involves:
a) Selecting a Product and date (for Trainings).
b) Completing the order form with the required details.
c) Selecting a payment method.
d) Accepting the Terms and confirming the order by clicking the appropriate button.
3. Product descriptions on the Website constitute an invitation to conclude a contract and do not constitute an offer within the meaning of the Civil Code.
4. The Agreement is deemed concluded at the moment the payment is credited to the Organizer or when the Client receives an order confirmation by e-mail.
5. The Client is required to provide accurate and up-to-date information in the order form. The Organizer reserves the right to cancel an order in the event of false information being provided.
6. After placing an order, the Client receives a confirmation by e-mail with the order number, information about the selected Product, and the date of the event.
7. The terms of Corporate Events are agreed individually by e-mail or phone, and the Agreement is concluded after all details have been agreed by both parties.

§ 6. PRICES AND PAYMENTS
1. All prices on the Website are quoted in Polish zloty (PLN) and euro (EUR) and include 23% VAT (gross prices). The EUR price is for informational purposes only; payment is made at the exchange rate of the payment operator on the day of the transaction.
2. The Organizer accepts the following payment methods:
a) Bank card (Visa, Mastercard), BLIK, Apple Pay, or Google Pay — via the payment platform.
b) Bank transfer — to the Organizer's bank account specified in the order confirmation.
3. Online payments are processed by a third-party payment operator (currently: Stripe, Inc.). Bank card details are not stored by the Organizer and are not shared with third parties beyond what is necessary to process the transaction.
4. The Organizer is not liable for delays or unavailability of the payment service due to reasons attributable to the payment operator.
5. When bank transfer is selected, the order is reserved for 48 hours from the moment of placing it. If no payment is received within this time, the reservation is cancelled.
6. The Organizer may apply promotions, promo codes, and special offers. The terms of promotions are published at the time of their announcement. Promo codes:
a) Cannot be combined with other discounts unless the Organizer expressly states otherwise.
b) Have an expiry date.
c) Cannot be exchanged for cash.
7. Upon the Client's request, the Organizer issues a VAT invoice. The request must be submitted when placing the order or within 7 days of the purchase.

§ 7. GIFT VOUCHERS
1. A Voucher is a document entitling the holder to participate in a Training or receive services from the Organizer up to a specified nominal value.
2. Vouchers are available exclusively in paper form and are sent by post to the address provided by the Client. Delivery terms and costs are specified on the Website.
3. Types of vouchers:
a) Voucher for a specific Training — entitles the holder to participate in a specified type of course.
4. The validity period of the Voucher is 3 months from the date of purchase, unless otherwise indicated in the description.
5. A Voucher may be used only once. Any unused portion of the nominal value is non-refundable.
6. If the order value exceeds the nominal value of the Voucher, the Client pays the difference.
7. A Voucher cannot be exchanged for cash and is non-refundable, except in the case provided for in item 9.
8. In the event of a Training being cancelled by the Organizer (see § 9 item 5), the Client holding a Voucher is entitled to:
a) Participate in the Training on a new date proposed by the Organizer, or
b) Receive a new Voucher of the same nominal value.
9. A gift voucher purchased as a gift does not give the recipient the right to withdraw from the contract. This right belongs exclusively to the Client (purchaser of the Voucher) and only within 14 days of purchase, provided the Voucher has not yet been used.

§ 8. CORPORATE EVENTS AND TEAM BUILDING
1. Corporate services are provided on the basis of individual arrangements between the Organizer and the corporate Client.
2. A corporate service order is placed by contacting via e-mail or phone, followed by written (e-mail) agreement on the terms.
3. The minimum number of participants and pricing conditions are determined individually.
4. To confirm the booking of a date, a deposit must be paid in an amount agreed with the Organizer (no less than 30% of the order value).
5. Conditions for cancelling a corporate event:
a) More than 21 days before the event date — the deposit is refunded in full.
b) 8 to 21 days before the event date — 50% of the deposit is non-refundable.
c) 7 days or less before the event date — the deposit is non-refundable; in the case of full payment for the service — 50% of the order value is retained.
6. The Organizer reserves the right to modify the event conditions for organizational reasons, while maintaining the standard and scope of the service.

§ 9. CONDUCTING TRAININGS — DATES AND CHANGES
1. Trainings are conducted on the dates and at the locations specified on the Website or agreed with the Client individually.
2. The Client has the right to reschedule the Training date once, free of charge, provided that:
a) The rescheduling request is submitted no later than 7 calendar days before the planned Training date.
b) The new date is selected from the dates available in the Organizer's schedule.
3. The rescheduling request must be sent by e-mail to: centrum.sbz@gmail.com with the order number.
4. A rescheduling request not submitted within the specified deadline is treated as a withdrawal from participation without the right to a refund.
5. In the event of a Training being cancelled by the Organizer (for organizational, weather-related, or other reasons):
a) The Client is offered a new date for the event.
b) If the Client does not accept the new date, 100% of the paid amount is refunded.
6. The Organizer is not liable for the Client's costs related to travel, accommodation, or other expenses associated with a cancelled Training.
7. The Organizer reserves the right to change the Training venue for reasons beyond its control, while maintaining the standard and curriculum.

§ 10. RIGHT OF WITHDRAWAL
1. In accordance with Art. 38(12) of the Polish Consumer Rights Act of 30 May 2014, the Consumer does not have the right to withdraw from the contract in respect of a Training conducted on a specific date (event with a fixed date). The purchase of a Training is final from the moment the payment is credited, except for the possibility of rescheduling provided for in § 9.
2. In respect of Vouchers, the Consumer has the right to withdraw from the Agreement without giving a reason within 14 days of the date of purchase, provided the Voucher has not yet been used (applied to purchase a Training or other service). The withdrawal notice must be sent by e-mail to: centrum.sbz@gmail.com.
3. The right of withdrawal does not apply to Vouchers that have already been used.
4. To withdraw from the Voucher purchase agreement, the Consumer sends an unambiguous written statement to the Organizer's e-mail address.
5. In the event of a lawful withdrawal from the Voucher purchase agreement, the Organizer refunds the full amount within 14 days of receiving the statement, using the same payment method that was used for the original payment.

§ 11. COMPLAINTS
1. The Client has the right to file a complaint in connection with the conduct of a Training, a Voucher, or any other service.
2. Complaints should be submitted electronically to: centrum.sbz@gmail.com within 14 days of the occurrence of the grounds for the complaint.
3. A complaint must include:
a) The Client's first and last name.
b) The order number.
c) A description of the problem and the Client's request.
4. Complaints are handled within 14 business days of receipt. The response is sent to the e-mail address provided by the Client.
5. For Consumers — failure to respond within 14 days is equivalent to acknowledging the complaint as valid.
6. The Consumer has the right to use out-of-court dispute resolution methods, including through the European ODR platform: https://ec.europa.eu/consumers/odr.

§ 12. PERSONAL DATA AND GDPR
1. The controller of Clients' personal data is CENTRUM ROZWOJU I BEZPIECZENSTWA Sp. z o.o., ul. Grzybowska 87, 00-844 Warszawa, e-mail: centrum.sbz@gmail.com.
2. Personal data are processed for the following purposes:
a) Conclusion and performance of the Agreement (Art. 6(1)(b) GDPR).
b) Compliance with legal obligations (Art. 6(1)(c) GDPR).
c) Direct marketing, including sending information about Trainings and promotions — exclusively with the Client's consent (Art. 6(1)(a) GDPR).
3. Clients' personal data are not transferred outside the European Economic Area, except for the transfer to Stripe, Inc. (USA) of data necessary for payment processing, on the basis of standard contractual clauses approved by the European Commission.
4. The Client has the right to: access their data, rectify it, delete it, restrict processing, data portability, object, as well as withdraw consent (without affecting the lawfulness of processing prior to withdrawal).
5. Detailed information on the processing of personal data is contained in the Privacy Policy available at berserk.com.pl.
6. The Client has the right to lodge a complaint with the supervisory authority — in Poland this is the President of the Personal Data Protection Office (UODO).

§ 13. NEWSLETTER AND MARKETING COMMUNICATIONS
1. When purchasing a Training or Voucher, the Client may give separate, voluntary consent to receive the Organizer's newsletter.
2. The newsletter contains information about new Training dates, promotions, special offers, and educational materials related to shooting sports.
3. The Client has the right to unsubscribe from the newsletter at any time by clicking the unsubscribe link in any message or by sending a request to: centrum.sbz@gmail.com.
4. Unsubscribing from the newsletter does not affect the performance of purchased Products.

§ 14. FINAL PROVISIONS
1. These Terms enter into force on 1 June 2025.
2. The Organizer reserves the right to amend these Terms. Clients with active orders will be notified of changes by e-mail at least 14 days before they take effect.
3. Agreements concluded before the amendment of the Terms are governed by the Terms in force at the time the agreement was concluded.
4. All disputes related to Agreements concluded through the Website are resolved by the court with jurisdiction over the Organizer's registered office. In respect of Consumers, jurisdiction is determined in accordance with general rules.
5. These Terms are available in Polish, Russian, and English at berserk.com.pl. In the event of discrepancies between language versions, the Polish version shall prevail.
